As Mr Lowry had admitted the breach it is found to be proved.

Penalty:

Mr Lowry is suspended for six days, from the end of racing today up to and including 18 March.

Facts:

Mr McIntyre alleged that Mr Lowry had failed to make the contract weight for RAISE YA CARDS in race 1 and was replaced.

Mr McIntyre stated that the respondent had come to the Stewards before race 1 and had indicated he would be unable to make the weight for RAISE YA CARDS. He was replaced by Ms T Comignaghi who was of similar ability. He said the respondent had had a similar issue at Wingatui at the end of last month. Both those people who had invested on the horse and the connections expected Mr Lowry to be the rider.

Mr Lowry said he was down to ride at 56.5 kg. He could not make that weight despite trying since 5 am. He said his other rides were at 57 kg or more and he could make those weights. He said he was very disappointed with himself and acknowledged it was not very professional.

Mr McIntyre stated that the RIU would require that Mr Lowry not accept rides under 57 kg in the future.

Mr McIntyre produced the respondent’s record. This evidenced four breaches since 1 December last. He submitted a 7-day suspension was appropriate.

Mr Lowry said RAISE YA CARDS was a family-owned horse and it was not the easiest to ride. That was why he had agreed to take the mount. It was a “big mistake” on his part.

Reasons for Penalty:

This is Mr Lowry’s fifth breach of the weight rule in the past three months. We accept the respondent has weight issues and has done his best to make the weight. However, he again has been unable to do so. The principal mitigating factor is his ready admission of the breach. That a rider of similar calibre was able to replace Mr Lowry is fortunate but that is not something that we can view as a mitigating factor.
