After the running of Race 4, The MaCauley Ford and Tui 1200m, an information (7272) was lodged by Stipendiary Steward Mr R Neal under Rule 638 (1)(D) alleging that Jockey CW Johnson allowed his mount CAW to shift outwards causing a check to BALLAPHUN (J Todd) near the 100 metres.

After the running of Race 4, The MaCauley Ford and Tui 1200m, an information (7272) was lodged by Stipendiary Steward Mr R Neal under Rule 638 (1)(D) alleging that Jockey CW Johnson allowed his mount CAW to shift outwards causing a check to BALLAPHUN (J Todd) near the 100 metres.
--The Rule reads:
that no jockey/rider shall not ride a horse in a manner, which the Judicial Committee considers to be, ..carless
It was noted that rider CW Johnson admitted the breach.
--Stipendiary Stewards Mr M Davidson and Mr R Neal, used several video clips of the incident. Mr Neal stated that Jockey J Todd (BALLAPHUN) was well established in a gap, three quarters of a length off CAW.
--Highlighting the video clip again Mr Neal illustrated that the outward movement of CAW had denied BALLAPHUN the opportunity to continue that line.
--Mr Neal also told the Committee that CAW was under a vigorous ride, but Jockey Johnson did not appear to make any effort to correct any outward movement, with the resultant check on BALLAPHUN happening at a critical time.
--Mr Neal offered no opinion as to whether BALLAPHUN would or could have finished third or fourth.
--Mr Johnson stated that his horse CAW had been a difficult horse to ride, especially steering around bends.
--SUBMISSIONS ON PENALTY
--Mr Neal stated that Mr Johnson had an excellent riding record and was known as a national rider, riding in both the North and South Island regularly.
--Mr Johnson in the past twelve months had one breach under Rule 638 (1)(D) on the 19th of September at Riccarton where he received a seven day suspension.
--Mr Neal confirmed that this breach was at the higher end of the scale, but on this occasion Mr Neal believed the breach was at the lower end of the scale.
--Mr Johnson had no Submissions on Penalty.
--DECISION
--The Committee was satisfied a breach of the Rule had occurred, and the information was upheld.
--In fixing penalty consideration was give to Mr Johnson’s guilty plea, and his previous riding record under this Rule in the past twelve months.
--The Committee also acknowledged Mr Neal’s statement that the breach was an error of judgement, and in his opinion at the lower end of the scale.
--The Committee also considered the statements made regarding CAW’s racing manners.
--The Committee also confirm that we are aware of Mr Johnson’s up and coming riding committments in both the South and North Island.
--Mr Johnson was suspended from race riding, from the conclusion of racing on Sunday 25th October until the conclusion of racing on Friday 30th October 2009, effectively four riding days.
