Prior to the start of Race 1 The Auto Windscreen Replacements 1400m an information (5509) was lodged by Stipendiary Steward Mr R Neal alleging under Rule 330 (3)(c) that Jockey J Laking failed to make the contract weight of 55.5kg for JADE FLIGHT and was replaced by J Morris.

The Rule reads:
A rider shall not .. (c) fail to ride a horse at the weight at which it is handicapped to carry.

Mr Laking admitted the breach.

Mr Neal told the committee that Mr Laking advised him thirty minutes before race start that could no make the carded weight 55.5kg for JADE FLIGHT, being ¾kg overweight.

Mr Laking told Mr Neal he thought he would be able to ride the horse earlier in the day, but found arriving at the course; he was unable to do so.

SUBMISSIONS ON PENALTY

Mr Neal stated that Mr Laking had breached Rule 330 (3)(c) once in the past twelve months, on 31 Mary 2009 at the Otago Meeting where he was fined the sum of $200.00.

Mr Neal also informed the committee that in this instance only one horse had been affected.

--

Mr Laking offered no Submission on Penalty.

DECISION

--

The Committee was satisfied a breach of the Rule had occurred and Mr Laking was fined the sum of $200.00, and reminded of his professional obligations.
