An information was lodged by Stipendiary Steward Mr S Ching, alleging that with approximately 800 metres to race KELLY CULLEN (Nathan Hanley) moved outwards when insufficiently clear

DECISION AND REASON:

--

An information was lodged by Stipendiary Steward Mr S Ching, alleging that with approximately 800 metres to race KELLY CULLEN (Nathan Hanley) moved outwards when insufficiently clear causing KIMBERLEY BOY (Ashlee Mundy) to be checked.

--

Mr Lawson, Stipendiary Steward, used several video clips of the alleged incident to highlight, in his opinion, where the incident occurred, and the subsequent effect to KIMBERLEY BOY.

--

Mr Ching believed that Mr Hanley had made an error of judgement, that was, in his opinion, at the lower end of the scale of carelessness.

Mr Hanley did not dispute any of the submissions made by Mr Ching or Mr Lawson. Mr Hanley also stated that KELLY CULLEN was over racing at the time of the alleged incident, which resulted in him taking the action he did.

Mr Ching agreed that KELLY CULLEN was proving difficult, but that Mr Hanley had taken his action too soon, when not sufficiently clear of KIMBERLEY BOY (Approx. one length).

--

In fixing penalty Mr Ching outlined that Mr Hanley had an excellent riding record over the previous twelve months, with one careless riding charge having been upheld throughout this period. Mr Ching also stated that Mr Hanley was riding regularly in both the North and South Islands.

Mr Hanley stated that he had riding commitments in the up and coming weeks at the following meetings ? Woodville (23), Paeroa (25) not confirmed, New Plymouth (26), Banks Peninsula (28), Riverton (29).

Mr Hanley confirmed he had tentative air bookings to attend the North Island meetings.

--

Mr Ching outlined to the committee that the meetings to be held on the 23rd and the 25th could not be taken into consideration should the committee consider a suspension be imposed.

--

The committee adjourned to seek further clarification of several aspects of Mr Hanley's up and coming commitments.

On fixing penalty the committee considered the following points:

  1. Mr Hanley's frank and open statements and guilty plea.
  2. --
  3. Mr Hanley's very good recent riding record (confirmed by Mr Ching).
  4. --
  5. The incident was at the lower end of the careless scale (confirmed by Mr Ching).

Mr Hanley was suspended up to and including the conclusion of racing on Thursday 26th October 2006. Mr Hanley was also fined the sum of $500.
