----Mr Ching has said the carelessness consisted in your continuing to use the stick even as ULTIMATE HIGH was moving sideways at quite some rate. You’ve said in mitigation that you were using the stick as an aid to keeping the horse straight and that if you’d put the stick away the horse would have moved even more sharply.
----Mr Ching has said the breach was mid range and has asked for a starting point of a suspension of 3 days. Mr Skerrett you’ve said you believe if a penalty is imposed, it should be a suspension.
----We accept the breach is mid range. We take into account your admission of the breach, Mr Skerrett, but balance this against the fact that you never missed a beat in riding out the horse with the whip despite the sideways movement, and also the fact that the incident resulted in the relegation of ULTIMATE HIGH. We believe a suspension of 3 days is appropriate. You have asked that the commencement of the suspension be after the meeting at Riverton this Friday where you believe you have a number of rides. Mr Ching has indicated that he has no objection to this. You are suspended from riding at the conclusion of racing on Friday 26 October up to and including Saturday 10 November. This is 3 South Island days and includes a premier day.
