Mr McKeon you’ve admitted a breach of rule 520(4)(c) in race 7 in that you were the declared rider of LIVE THE REALITY and failed to make the contracted weight of 54 kg.
----You’ve described the concerted efforts you made earlier today to make 54 kg and have emphasised that you informed Mr Ching at the commencement of the day that you were having difficulty in making the weight. Mr Ching accepts this, but states you could have contacted him yesterday and other arrangements could have been made. He asks for a fine in the range of $350 to $400.
----Mr McKeon you state this is your first such breach in 2000 rides since arriving in New Zealand, that you have had 800 rides in the past 12 months, and ask for a fine of $50 to $100. We observe 3 recent South Island fines for a breach of this rule to be in the range of $200 to $300. Taking into account the mitigating factors, we fine you the sum of $200 but emphasise that any further breach of this rule will clearly result in a more substantial penalty. In future you must ensure that any agent you use does not accept a ride at a weight that you are not likely to be able to make.
