Facts:
Following the running or race 8 the “Parkside Panels/Woodlands Tavern Maiden“ Stewards charged Mr Murray (Our Boy Baz) with a breach of rule 638 (3) (b) (ii) alleging that Mr Murray “… used his whip in an excessive manner prior to the 100 metres.”
Rule 638 provides as follows:
(3) A rider shall not
(b) strike a horse with a whip in a manner or to an extent which is:
(ii) excessive.
The “Guidelines with Respect to Acceptable Use of the Whip” provide as follows:
Without affecting the Generality of the Rule 638(3)(b) a rider may be penalised if their whip use is outside the following guidelines:
Inside the final 600 metres of any race, official trial or jump-out a horse may be struck with the drawn whip up to five times after which the rider must cease their use of their whip for a minimum of five strides before striking the horse again with the drawn whip, with this restriction to apply to the final 100 metres. The whip may then be used at the rider’s discretion until the winning post is reached. Prior to the final 600 metres of a race, official trial or jump-out the use of the drawn whip is acceptable if used in moderation and not continually.
Mr Murray admitted the breach and appeared at the hearing assisted by Mr D Walsh.
With aid of the video replays Mr Davidson said Our Boy Baz was racing handy to the lead approaching the 100 metres mark. He said Mr Murray drew his whip and struck Our Boy Baz approximately 9-10 times. However he had only given his horse a break for two strides in between use of the whip. He stated the use of the whip and the number of strides between whip use was in breach of the rule.
Mr Murray accepted the evidence of the Stewards. Mr Walsh stated that Mr Murray had only just returned to race riding after an absence of several years. He said during that absence the whip regulations had changed considerably and Mr Murray was still adjusting to those changes.
Submissions for Penalty:
Mr Davidson said Mr Murray had a clear record and this was his first breach of the rule. The JCA Penalty Guide recommended a fine of $300.
Mr Murray accepted the submissions of the Stewards.
Reasons for Penalty:
There are no aggravating features to this breach of the rule. Mr Murray has an excellent record and admitted the breach at the outset. A fine is appropriate.
