Facts:
At the conclusion of Race 1, the WYNDHAM WORKOUTS COMMITTEE TROT, an information was lodged by Mr Ydgren under r 870(5) alleging STARLIGHT STARBRIGHT was in its incorrect gait in that it paced over the finishing line when lapped on by TACHMA.
Judge’s placings were:

The official margin between 1st and 2nd was a neck (0.3L).
Rule 870(5) states:
Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869(8)) such relegation of the horse shall be at the discretion of the Judicial Committee.
Submissions for Decision:
Mr Renault, Stipendiary Steward, demonstrated that STARLIGHT STARBRIGHT, switched into a pace right on the finishing line. STARLIGHT STARBRIGHT was lapped on by TACHMA.
Mr Ydgren replayed the head-on and side-on videos. These were synchronised. The frame before the line showed that STARLIGHT STARBRIGHT was still trotting and the frame after the post evidenced the horse was in a pace. It was not possible to tell from the side-on video of STARLIGHT STARBRIGHT at the winning post whether it was trotting or pacing due to the horse being obscured by the runner on its outer, TACHMA.
Mr Beck, who confirmed he represented the connections of STARLIGHT STARBRIGHT, stated that it was a 50/50 call. He believed it was impossible to tell if STARLIGHT STARBRIGHT was pacing or trotting at the line.
Mr Ydgren acknowledged this and was of the opinion that STARLIGHT STARBRIGHT was transitioning into a pace at the winning post.
Reasons for Decision:
Despite the benefits of modern technology it is impossible to determine whether STARLIGHT STARBRIGHT was in a pace at or immediately after the winning post. In these circumstances the benefit of the doubt is given to STARLIGHT STARBRIGHT and the placings are as called by the Judge.
