Under Rule 869 (8) (9) + (b), following the running of Race 7, the Kina Craig Stud Mobile Pace, an information instigating a protest was filed by Stipendiary Steward Mr C Allison alleging ECHOVALE AVE driven by Mr R Jenkins, shifted out, checking JET LIGHTENING driven by Mr A Suddaby, with approximately 400 metres to run.



DECISION & REASON

Under Rule 869 (8) (9) + (b), following the running of Race 7, the Kina Craig Stud Mobile Pace, an information instigating a protest was filed by Stipendiary Steward Mr C Allison alleging ECHOVALE AVE driven by Mr R Jenkins, shifted out, checking JET LIGHTENING driven by Mr A Suddaby, with approximately 400 metres to run.

Video footage of the incident demonstrated by Mr Allison shows ECHOVALE AVE racing on the inside of JET LIGHTENING, both horses racing just in behind the leading horses.  At about the 400 metre mark, Mr Jenkins pushes Mr Suddaby’s horse JET LIGHTENING out.  In this manoeuvre JET LIGHTENING breaks for a few strides.

Mr Suddaby maintained that Mr Jenkins had attempted to push him out some 50 metres prior to this, causing them to lock wheels and in freeing himself Mr Suddaby had lost his position slightly, thus enabling Mr Jenkins to then successfully push out.  Mr Suddaby maintained that this movement had cost him the opportunity of finishing closer, as his instructions were to not pull out until the 200 metre mark as his horse did not have a sustained sprint.  This was confirmed by JET LIGHTENING’s trainer Mr D Simpson.

Mr Jenkins maintained he had locked stays with Mr Suddaby momentarily before he pushed out.  Mr Jenkins believed he was perfectly entitled to push out when he did.  Mr Jenkins further demonstrated on the video footage that JET LIGHTENING had not lost any ground other than to be forced wider on the track.

ECHOVALE AVE ran on to finish 2nd, and JET LIGHTENING 4th.

Despite the fact that JET LIGHTENING finished ½ length from ECHOVALE AVE and ½ head from the third horse, the Committee has given the benefit of the doubt in favour of Mr Jenkins in that he did not interfere with Mr Suddaby’s horse and that any advantage he may have gained by his pushing out, or perceived diminishing of Mr Suddaby’s chances of finishing closer, resulted from competitive driving at that stage of the race.

The protest is therefore dismissed.
