Following the running of Race 1, the Wyndham Sunday Workouts Mobile Pace, an information was filed by Stipendiary Steward Mr C Allison against horseman Mr B R Shirley alleging that Mr Shirley used his whip excessively in the home straight.
DECISION REASON & PENALTY
--Following the running of Race 1, the Wyndham Sunday Workouts Mobile Pace, an information was filed by Stipendiary Steward Mr C Allison against horseman Mr B R Shirley alleging that Mr Shirley used his whip excessively in the home straight.
--Mr Shirley admitted the breach and did not wish to be present.
--Video footage of Mr Shirley’s whip action in the home straight was demonstrated by Mr Allison. This shows Mr Shirley using his whip 22 times on his horse CAPTAIN KHAN which ultimately ran fourth in the event. Mr Allison stated that the actions of Mr Shirley were excessive when interpreting the intention of the use of whip guidelines issued in August 2006.
--When assessing penalty Mr Allison suggested a fine in the region of $200 - $250 would be reasonable in this case. Mr Shirley had previously been warned on at least two previous occasions within the past 12 months regarding his use of the whip.
--The Committee acknowledges Mr Shirley’s guilty plea when assessing penalty, however has to take into account the warnings issued to Mr Shirley. Accordingly, Mr Shirley is fined the sum of $250.
