At the conclusion of race 3 the Macca Lodge/Nevele R 3YO Mobile Pace A protest was lodged by Stipendiary Steward Mrs K R Williams alleging under rule 870(3) and the breaking horses regulation that the 3rd placed horse by the judge, Essene (A Sanderson) galloped in excess of 50metres in the run home.
The rule reads 870(3)
Any horse which breaks from it’s gait shall promptly regain it’s proper gait.
Facts:
Mrs Williams showed the committee several video clips of the alleged incident highlighting Essene when leading galloping out of it’s gait and an excess of 50metres in the home straight.
Essene did not interfere with the chances with any other horse and finished in 3rd place at the conclusion of the race.
Mr Larsen the trainer of Essene after viewing the video clips did not wish to contest the protest.
Submissions for Decision:
Mrs Williams requested that Essene be disqualified from 3rd placing.
Reasons for Decision:
The committee was satisfied a breach of the rule had occurred as Essene had clearly galloped in excess of 50 metres in the run home and as a result the protest was upheld.
