Mr Renault alleged that in Race 7, the BIG JIM @ALABAR PACE, Ms Barclay (THE TISBURY TERROR) used her whip excessively in the run home.
Rule 869(2)(a) provides: “No horsewoman shall during any race use her whip in an unnecessary, excessive or improper manner.”
Mr Renault demonstrated on the videos that the respondent used her whip 21 times in the run up the straight. While her action was repetitive, there was the odd pause together with the use of the reins.

Mr Renault produced the respondent’s record. She has had 2600 lifetime drives, with 92 drives this season and 165 last. She has not breached this rule in the past 2 seasons. He described the breach as mid to low range and submitted a fine of $200 was appropriate.

We believe the breach is low range. There are 21 strikes and these are broken by the odd pause and there is also the use of the reins to urge the horse from time to time. We have regard to the respondent’s admission of the breach and her excellent record under this rule in recent times.
