Facts:
At the conclusion of Race 6, the INTERNATIONAL GARDEN RESCUE TROT, an information was lodged by Mr Renault under r 870(5) alleging WHENDABOYSLITEUP broke prior to the finishing line and was lapped on by FINAL SECRET.
Judge’s placings were:
1st 1 MR MAYFLY
2ND 8 TRADE ME NOW
3RD 4 WAITOTO EXPRESS
4TH 9 WHENDABOYSLITEUP
5TH 2 FINAL SECRET
The official margin between 4th and 5th was a head.
Rule 870(5) states:
Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869(8)) such relegation of the horse shall be at the discretion of the Judicial Committee.

Mr Renault demonstrated that WHENDABOYSLITEUP, when mounting a run down the outside of the track, galloped inside the final 50 metres. WHENDABOYSLITEUP was lapped on by FINAL SECRET.
Mr Murphy, the trainer and part-owner of WHENDABOYSLITEUP was present and after viewing the videos he stated that he did not contest the protest.
Reasons for Decision:
We are satisfied that WHENDABOYSLITEUP galloped just prior to the winning post and was not in its correct gait when it crossed the finishing line. The horse, which had not suffered interference from any other runner, was lapped on by FINAL SECRET.
