--After the running of Race 5 an information # 67433 was lodged by Stipendiary Steward Mr P Knowles under Rule 869 (2) (a) alleging that Mr R Hayter (CHAY BROMAC) used his whip excessively over the final 300 m.
--Rule 869 (2) (a) reads : No Horseman shall during any race : (a) use his whip in an unnecessary, excessive or improper manner.
--Mr Knowles used video film to highlight the alleged incident. He stated that Mr Hayter had used the whip some 22 times from the 300m. Mr Knowles also mentioned that there had been some gaps and that he presumed that Mr Hayter may have misjudged the length of the straight and had tried to ‘break it up’.
--Mr Hayter, who admitted the breach, agreed that he had made a judgment error – stating that the length of the straight was much longer than he had anticipated.
--DECISION
--The Committee was satisfied that a breach of the Rule had occurred. Mr Knowles was asked for submissions on penalty. He stated that Mr Hayter was an Australian Senior Horseman driving in New Zealand and had no previous breaches of this Rule. Mr Knowles recommended a fine at the lower end of the scale.
--Mr Hayter was fined the sum of $200.
