An information # 67434 was lodged by Stipendiary Steward Mr P T Knowles under Rule 869 (3) (b) alleging that Junior Horseman A J Sanderson (BUTTONS AND BOWS) drove carelessly when allowing his horse to shift outwards causing LUCY’S ROCKET (R H Swain) to break approximately thirty metres from the finish.

Mr Sanderson admitted the breach and initially did not wish to have a senior horseman present at this hearing.  At the request of the Judicial Committee Mr Sanderson did seek advice from a senior horseman prior to the hearing commencing.

The Rule states that No Horseman shall drive carelessly.
It was agreed by all parties that the evidence from the Protest hearing (Information # 13350) was a true and accurate record and with no parties having any new or unheard information then the hearing would proceed to submissions on the penalty to be imposed.

Mr Knowles stated that Mr Sanderson was a junior horseman who generally had two or three drives on a race day and that over this past twelve months he had not had any breaches under this Rule.  Mr Knowles believed the degree of carelessness in this instance was at the higher end of the scale as BUTTONS AND BOWS had been relegated from second to fourth placing, with a financial loss to the owners of this horse and the investors on the horse.

Mr Sanderson clarified for the Committee his driving commitments in the up and coming weeks.

Mr Sanderson was fined the sum of three hundred ($300) dollars and was reminded of his professional obligations.
