Appearing Informant : Mr P T Knowles and Mr C J Allison, Stipendiary Stewards
Defendant : Mr A F J Sanderson, Junior Driver – BUTTONS AND BOWS
Witnesses : Mr R Swain, Driver – LUCY’S ROCKET
Mr K Larsen – assisting Mr Sanderson
At the conclusion of Race 6, The RKBM Ltd Fillies and Mares Mobile Pace, a protest was lodged by Stipendiary Steward Mr P T Knowles, under Rule 869 (8) (b) alleging that over the final stages BUTTONS AND BOWS, driven by Junior Horseman Mr A Sanderson, shifted ground outwards checking LUCY’S ROCKET, driven by Mr R H Swain.
--Mr Sanderson was assisted throughout the hearing by Senior Horseman Mr K Larsen.
--Stipendiary Steward Mr C J Allison read the Rule which states – Any horse which may have interfered with or whose horseman may have interfered with the progress or chance of any other horse or horses immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected
--Mr Allison showed several video clips of the alleged incident stating that over the final stages BUTTONS AND BOWS (A Sanderson) shifted ground outwards over the final stages checking LUCY’S ROCKET, driven by Mr R H Swain.
--Mr Swain stated that a gap opened up and he went through it with LUCY’S ROCKET. However BUTTONS AND BOWS moved outwards causing his wheel to get hooked up on the back leg of BUTTONS AND BOWS causing LUCY’S ROCKET to break. Mr Swain stated his horse LUCY’S ROCKET would have finished third, given a clear uninterrupted passage to the winning post.
--Mr Sanderson did not dispute that his horse BUTTONS AND BOWS had moved out and had come into contact with LUCY’S ROCKET. Mr Sanderson suggested that his horse may have reacted as a result of the inside horse moving outwards slightly.
--Mr Larsen acknowledged contact had been made by BUTTONS AND BOWS running outwards.
--DECISION
--The Committee was satisfied that interference had taken place with BUTTONS AND BOWS clearly moving outwards, impeding LUCY’S ROCKET’s finishing run to the winning post. The protest was upheld, with BUTTONS AND BOWS relegated from second to fourth placing.
--The official judges placings now read :
--1st (9) FELICITY ROBYN
2nd (11) RED HOT LOVER
3rd (17) LUCY’S ROCKET
4th (7) BUTTONS AND BOWS
