Mr Munro alleged that in Race 8 horse number 6 WHATWILLBEEWILLBEE broke in excess of 50 metres in the final 200 metres of the race.
Mr Munro sought disqualification of WHATWILLBEEWILLBEE pursuant to r 1003(2).

Mr Munro demonstrated on the videos that WHATWILLBEEWILLBEE was not in its proper gait for some 100 metres in the home straight.
Mr Orange, the driver of WHATWILLBEEWILLBEE, represented the connections and did not contest the protest.
Reasons for Decision:
After viewing the videos from the various angles, the Committee is satisfied that WHATWILLBEEWILLBEE was not in its proper gait for a distance in excess of 50 metres in the final 200 metres. WHATWILLBEEWILLBEE was free of interference at the time. The Breaking Horse Regulations are clear in that the horse is deemed to be in breach of r 870(3) in that it has failed to promptly regain its proper gait.
