Mr Campbell is fined the sum of $200, as per the JCA Penalty Guide, and is reminded of his obligations under the Rules of Harness Racing. 

Facts:

Miss Haley, Stipendiary Steward, alleged that Mr Campbell the driver of JACCKA TED in race 6, used his whip on more occasions than is permitted by the Use of the Whip Regulations. This is a breach of r 869(2).

Miss Haley identified JACCKA TED on the race films. She demonstrated that the Respondent, who was in trail at the 400 metres, used his whip 12 times to the winning post. The horse finished 1st.

Mr Campbell did not require the assistance of a senior horseman. He accepted there were 12 strikes. He said he was not counting and, in the heat of the moment, although he was trying to break up his whip use, he was in breach of the Rule. He added his horse had been responding better when he used the whip.

Miss Haley produced Mr Campbell ’s record. This was Mr Campbell’s 11th drive this season. He had 67 drives last season. His record was clear under this Rule this season.

Miss Haley submitted that a fine of $200 was appropriate. She said the Respondent was a busy South Island Junior Driver with a very good record.

Mr Campbell did not disagree with Miss Haley’s submissions.

Reasons for Penalty:

We agree there are 12 strikes. That his horse had been responding better when he used the whip is no excuse for Mr Campbell’s breach of the Rules. This is the Respondent’s first breach of this rule this season.
