Mr Tidmarsh, Stipendiary Steward, alleged that horse 17 WALK LIKE A MAN in race 3, the STEWART TOWN VINEYARD/GOODMAN PLUMBING/GARY ANDERSON PACE, galloped over the concluding stages and was lapped on by TACT DENZEL.
Judge’s placings were:
1st - 5 NADEEN FRANCO
2nd - 8 RAFA NOVAK
3rd - 17 WALK LIKE A MAN
4th - 15 TACT DENZEL
The official margin between 3rd and 4th was ¾ of a length.

Rule 870(5) states:
Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to r 869(8)) such relegation of the horse shall be at the discretion of the Judicial Committee.
Mr Tidmarsh demonstrated on the videos that in his view WALK LIKE A MAN, within the final 40 metres broke and continued in a gallop past the finishing line. He demonstrated with reference to the side on and head on videos and by freezing the footage that the horse was in a gallop as its nose passed the post and that it was lapped on by TACT DENZEL.
Mr N Williamson, the driver of WALK LIKE A MAN, represented the connections of that horse, and did not contest the protest.
Reasons for Decision:
We are satisfied that WALK LIKE A MAN was in a gallop at the winning post, and was lapped on by TACT DENZEL. The horse galloped for some 6 strides and resumed pacing just after the winning post. The margin between third and fourth was 3/4 of a length. WALK LIKE A MAN has broken free of interference and in these circumstances we relegate WALK LIKE A MAN to behind TACT DENZEL.
