An information was laid by Stipendiary Steward Mr C J Allison, alleging that Mr A W Scobie used his whip excessively over the concluding stages whilst driving MAN IN BLACK, in Race 10.
--Mr Scobie admitted the breach, but chose not to appear.
--Mr Allison used several video clips to highlight the alleged incident, stating that he believed Mr Scobie had struck MAN IN BLACK on thirty eight occasions continually. MAN IN BLACK finished second, a head from the winner who finished strongly from behind MAN IN BLACK.

PENALTY
--In fixing penalty, consideration was given to Mr Scobie's guilty plea. Mr Scobie had been previously charged on the 19th November 2006 and fined $250, and warned on 27th December 2006 under the same Rule.
--In my opinion the breach was at the higher end of the scale and as a result Mr Scobie was suspended up to the conclusion of racing on 9th March 2007.
