Mr Cox admitted the breach, which we find proved. 

Penalty:

The Committee fined Mr Cox the sum of $300 and reminded him of his professional obligations. 

Charge:

An information was laid by Stipendiary Steward Mr Wallis at the conclusion of race 8 alleging that J W Cox, driver of POCKET SALI, used his whip excessively when driving out POCKET SALI over the final stages. 

Facts:

Mr Wallis showed the Committee several video clips of the incident, highlighting Mr Cox striking his horse POCKET SALI twenty times from the top of the straight to the winning post. 

Mr Cox confirmed the number of strikes to be twenty, with the last four or five being in very quick succession.

Submissions for Penalty:

Mr Wallis stated that Mr Cox had one previous breach under this rule, occurring at the Forbury Park meeting in June 2012 when Mr Cox was fined the sum of $200.

Mr Wallis referred to the JCA penalty guide and asked this Committee to consider a penalty of up to $500, as it was the respondent's 2nd breach within a twelve month period.

Mr Cox had no submissions on penalty.

Reasons for Penalty:

We believe the breach is mid range. The previous breach at the Forbury Park meeting in June 2012, when Mr Cox was fined a sum of $200, was almost identical in nature. We are concerned that the respondent is failing to heed the need to comply with the rule.

In assessing penalty, consideration was also given to Mr Cox’s guilty plea, along with the fact that he was a senior horseman, and that although this was a second breach, this was to be considered in the context that he had a number of drives on racedays.
