Facts:
At the conclusion of race 1 The Hokonui Honda Trot a protest was lodged by Stipendiary Steward, Mr S W Wallis under rule 870(3) and the breaking horse regulations, that the fourth placed horse by the judge MOKOSUN (B McLellan) broke on the final bend and continued in a break over the finishing line.
Judges placings were:

3rd – 11 VEECEWAH (A Milne)

Mr Wallis showed the Committee several video clips of the incident, highlighting MOKOSUN breaking on the final bend and galloping to the winning post.
Mr McLellan the driver of MOKOSUN represented the owners of the horse, and stated he did not contest the protest.
Reasons for Decision:
In exercising our discretion and disqualifying MOKOSUN we are satisfied that MOKOSUN was out of its correct gait for a distance in excess of 200 metres. MOKOSUN broke at the top of the straight and did not return to its proper gait for the entire length of the straight.
