870(5), Notwithstanding the provisions of sub rule (4) hereof any horse which is not in the correct gait when it’s nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in it’s correct gait as a result of interference to such horse or it’s horseman, then(subject to Rule 869(8))Such regulation of the horse shall be at the discretion of the Judicial Committee.

After the conclusion of race 7 the (Centrepoint Southcity Liquorland mobile pace. A protest was lodged by Stipendiary Steward Mr P T Knowles under rule 870(5) alleging that with approximately 40metres to run Rennie Sivad (C M Hanna) broke from its gait and galloped across the line, lapped on by Trinna Jaccka (K Barclay)
 

Submissions for Decision:

Mr C Hanna (Driver of Rennie Sivad) and Mr A Paisley (Trainer, Rennie Sivad) were both present, and after viewing the video clips of the alleged incident they did not want to contest the protest.

Reasons for Decision:

The committee was satisfied that clearly Rennie Sivad was in breach of the lapped on rule by galloping with 40 metres to run to the winning post and being lapped on by Trinna Jaccka and as a result, Rennie Sivad was relegated from second to third placing.
