DECISION AND REASONS:
--Stipendiary Steward, Mr P Knowles, alleged that Mr AJ Suddaby (ELUSIVE KATE) allowed his horse to drift outwards causing interference to CORINGA RUBY and causing CORINGA RUBY to break.
--It was agreed that evidence from the earlier protest be taken as read.
--Mr Suddaby admitted the offence and so under Rule 1111(1)(d) and the charge found proven.
--Submissions as to penalty were heard. Mr Knowles said the charge was at the bottom end of the scale, that Mr Barron had said initially that his horse may have contributed and the horse drifted only a little. He asked for a fine. He also pointed out that Mr Suddaby had a clean sheet for this offence.
--Mr Suddaby hoped for a small fine.
--The Chairman gave Mr Suddaby credit for his open and helpful approach and frank admission and his good record and took cognisance of Mr Knowles' comments. Mr Suddaby was fined $225.
