Facts:

Mr Renault, Stipendiary Steward, alleged that Ms Barron in race 9, the MLT/THREE RIVERS HOTEL Mobile Pace, used her whip on more occasions inside the final 400 metres than is permitted by cl (b) of the Use of the Whip Regulations.

Mr Renault demonstrated on the videos that the respondent, who was driving RAKSBET, was sitting parked and she used her whip 13 times in the last 400 metres.

Ms Barron indicated on the information that she admitted the breach and did not wish to be present at the hearing. Mr Renault confirmed that she had viewed the videos, agreed with Stipendiary Stewards’ count, and said she did not require the assistance of a senior driver.

Reasons for Penalty:

The count for Ms Barron is 13. We note the last 3 strikes, which put Ms Barron in breach of the rule, were not necessary as her horse, which had been sitting outside the leader on the home turn, was clearly giving ground not long after the field straightened for the run home. RAKSBET eventually finished last.

Ms Barron has a clear record under this rule. The Penalty Guide provides a $200 fine where the number of strikes is between 11 and 13 (low-range) and the respondent has a clear record. There are no aggravating or mitigating factors that require an adjustment to this starting point.
