Mr Alford was charged with a breach of r 869 (3) (b), in that he allowed his horse HELD TO RANSOM to strike the sulky wheel of SCHNITZEL VON KRUMM causing his horse to break and lose its chances. Mr Alford admitted the charge.
Miss Haley stated that HELD TO RANSOM was positioned four-back on the pole line as the field passed the final 400 metre mark. He said Mr Alford was seen to shift outwards approaching the home straight. However, there was insufficient room and HELD TO RANSOM broke for several strides, recovered briefly and broke again.
Mr Munro stated that SCHNITZEL VON KRUMM (M Williamson) was on his outer and under pressure. As that runner started to lose ground Mr Alford attempted to improve. He said his horse’s off-hind leg came into contact with the inside sulky wheel of SCHNITZEL VON KRUMM causing HELD TO RANSOM to break. The horse recovered briefly then broke again losing any chance. He said Mr Alford should have waited until SCHNITZEL VON KRUMM had drifted back further before coming out.
Mr Alford stated he’d anticipated the outside horse to drop back quicker but misjudged his outward movement. Mr Purvis stated it was only a couple of strides too soon.

Mr Munro said Mr Alford was in his second year of driving. He’d had 67 lifetime drives with 14 of those this season. He had a very good record with no previous charges under the rule. He sought a six drive suspension or a $300 fine. He said a mitigating factor was HELD TO RANSOM’S racing manners.
Mr Alford stated he would prefer a suspension as to a fine and requested a deferment to allow him to drive at Ashburton on the 14th November. He had admitted the breach and had a good record.
