Mr Renault alleged that Mr Williams failed to come up to and maintain his position behind the mobile in Race 9, the MLT/Pioneer Tavern Pace when driving BRINDY.
Rule 857(7)(g) provides: that no horseman shall fail to come up into and/or maintain his position.
Mr Renault demonstrated that BRINDY, which had drawn 8 behind the mobile, was out of position at the start in that that the horse was approximately a length and a half behind the arm. He stated it was the Stipendiary Stewards’ practice to issue a driver with one warning under this Rule before laying a charge. Mr Williams had been issued with a warning after Race 2.
Submissions for Penalty:
Mr Renault submitted that a penalty at the low end of the scale was appropriate.
Reasons for Penalty:
Taking into account the fact that Mr Williams has admitted the breach and is a busy driver with a clear record, we impose a fine of $150.
