In these circumstances r 870(5) requires us to relegate VEECEEWAH to behind MARSEILLES.

Facts:
At the conclusion of Race 1, the WYNDHAM WORKOUTS COMMITTEE TROT, an information was lodged by Mr Renault under r 870(5) alleging VEECEEWAH galloped over the finishing line when lapped on by MARSEILLES.
Judge’s placings were:
1ST 6 CONTINENTAL BOY
2ND 7 MOMENT OF SUN
3RD 8 VEECEEWAH
4TH 4 MARSEILLES
The official margin between 3rd and 4th was ¾ of a length.
Rule 870(5) states:
Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869(8)) such relegation of the horse shall be at the discretion of the Judicial Committee.
Mr N Williamson, the driver of VEECEEWAH, indicated on the information that he represented the connections of that horse and did not contest the protest.

Mr Renault demonstrated that VEECEEWAH, when mounting a run down the outside of the track, galloped inside the final 50 metres. VEECEEWAH was lapped on by MARSEILLES.
Reasons for Decision:
We are satisfied that VEECEEWAH galloped with some 30 to 40 metres to race. The horse, which had not suffered interference from any other runner, continued across the line in a gallop. It was lapped on by MARSEILLES, which although trotting roughly had not broken.
