Decision: Following the running of Race 2, an information instigating a protest was filed by Stipendiary Steward Mr C Allison against No.3 WASHINGTON BREEZE driven by Mr B Barclay and placed 1st by the judge

DECISION AND REASON:

--

Following the running of Race 2, an information instigating a protest was filed by Stipendiary Steward Mr C Allison against No.3 WASHINGTON BREEZE driven by Mr B Barclay and placed 1st by the judge, in that he moved out from the trailing position, taking the spot that No.8 EASTON FOXY LADY, driven by Mr B Norman, and placed 3rd by the judge, was both moving into and entitled to.

Rule 869(8)(b) was read by Stipendiary Steward Mr C Allison.

Stipendiary Steward Mr P Knowles used the video to highlight the alleged incident, stating that in his opinion, Mr Barclay the driver of WASHINGTON BREEZE, moved out from the trailing position, taking the spot that EASTON FOXY LADY, driven by Mr Norman, was both moving into and entitled to.   The move caused tightening and Mr Norman’s horse to be checked and to lose some ground, and position.

This contact could have caused a puncture – Mr Norman stated that the puncture had not affected his chance, and that if the horse was any good, it could have still have performed well, puncture and all.

Mr Norman said that the check would have cost him approximately one length – not as much as he first thought.

--

Mr Barclay stated that he thought that Mr Norman’s horse was still travelling behind him and that he moved out thinking that the space was clear.   He admitted being a little surprised when finding Mr Norman moving into the one/one position.

Stipendiary Steward Mr P Knowles stated that he was on duty at the top of the straight and did hear Mr Norman call out just prior to the incident.

Mr Hope, trainer of No.3 WASHINGTON BREEZE, stated that he agreed with evidence given.

--

Stipendiary Steward Mr C Allison, summed up by stating that he believed that the outward movement of WASHINGTON BREEZE (Mr Barclay), not only took the racing space that EASTON FOXY LADY but checked that horse causing it to lose ground and position.

Decision:

--

The committee’s decision is to uphold the protest and to relegate No.3 WASHINGTON BREEZE to third placing, effectively placing it behind the horse that was affected.

--

The chances of No.8 EASTON FOXY LADY were considerably affected when No.3 WASHINGTON BREEZE took both its space (that it was entitled to) and checking its progress.

--
