An information was filed by Stipendiary Steward Mr CJ Allison against Mr BG Barclay, alleging a breach of Rule 869(4), in that Mr Barclay as the driver of WASHINGTON BREEZE in Race 2, shifted ground outwards with approximately 300 metres to run causing EASTON FOXY LADY to be checked.
An information was filed by Stipendiary Steward Mr CJ Allison against Mr BG Barclay, alleging a breach of Rule 869(4), in that Mr Barclay as the driver of WASHINGTON BREEZE in Race 2, shifted ground outwards with approximately 300 metres to run causing EASTON FOXY LADY to be checked.
--All parties agreed to accept the evidence given in the protest hearing (Information No.12199).
--Stipendiary Steward Mr C Allison read Rule 869(4), and used video film to review the alleged incident.
--Mr Barclay added that in his view, any infringement was very minimal – that he saw the horse outside him in the one back/one out position move outwards. He decided to take that space, not fully realising that Mr Norman’s horse was moving forward into that space.
--The Committee found Mr Barclay guilty of the offence as charged.
--Penalty:
--The committee’s decision was to give Mr Barclay an official warning and remind him of his responsibilities as a driver.
--Reasons:
--1. The Stipendiary Steward stressed that the charge was at the most minor end of the scale.
--2. On checking Mr Barclay’s previous driving record it was found there was only one previous incident in Auckland. The Stipendiary Steward informed the committee that Mr Barclay had a fine record over many years and was rarely on any charge.
--3. Mr Norman’s previous evidence, emphasising that his horse was not as inconvenienced as he first thought.
--4. Reviewing the video film the committee considered the incident was more a result of 2-3 related factors and certainly not, in his opinion, not deliberate.
