The committee ruled that Snoop Dog was not denied a fair start and, therefore, that the horse be not declared a late scratching.
Facts:
Following the running of Race #1 The Woodlands Motors Ltd Trot information (A1408) by way of a Request for a Ruling was filed by Mr P Andrews, the Trainer of Snoop Dog, as to “whether Snoop Dog was denied a fair start”.
Mr Andrews was present at the hearing of the information and was assisted by Mr A Milne the driver of Snoop Dog.
Rule 213 Provides as follows:
1) A Stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all or any of the following grounds:
(j) If a horse was denied a fair start and such occurrence materially prejudiced the chances of that horse
Submissions for Decision:
Mr Milne told the committee that Snoop Dog had got quite fractious prior to the start and that the starter Mr B Ward had sent the horse to the Unruly position.
He stated that he asked Mr Ward to wait until he had the horse pointing in the right direction before he let the field go.
Mr Milne showed a video replay of the start of the race as the field was lining up and his position which was some distance back from the tape.
He pointed out that One Cool Chick driven by Mr R Swain, who was also starting from the Unruly position, 2 on the front line, was not in its right position.
Mr Milne said if the starter had held the field for a couple of more seconds he would have been right.
Mr B Ward (Starter) said he had sent the horse Snoop Dog to the Unruly position prior to the start because he was playing up. He said he saw Mr Milne turn his horse two or three times and that he gave him every opportunity to line up. The rest of the field was ready when the tapes were released.
Stipendiary Steward Mr C Allison said he had been asked to late scratch the horse but in his opinion he could see no interference or evidence to do so. In his opinion it was the horse’s manners that had let him down.
Mr Allison also said that the horse Snoop Dog did start a long way from the starting tape on the Unruly position.
Reasons for Decision:
It was clear to the committee from the video evidence that at the point that the field was released Snoop Dog had turned into its correct position, after being very fractious prior to this.
Mr Milne relied on the fact that One Cool Chick started in the wrong position, well back from where he should have been, and also that the starter Mr Ward did not wait long enough for him to line up Snoop Dog.
Those factors were of little relevance to the committee.
Mr Ward had placed the horse on the Unruly mark because of its poor manners prior to race start and had let the field go as they lined up across the starting tapes.
The committee was satisfied that no interference took place and that no circumstances existed that warranted it finding that the horse was denied a fair start.
