As Ms Fawcett admitted the breach, it was deemed to be proved.

Penalty:

Accordingly, Ms Fawcett’s License is suspended from the close of racing on Saturday May 15 up to and including racing on Thursday May 27. In addition, she is fined the sum of $500.

Facts:

Following the running of Race 3, an Information was lodged by Mr Coles alleging a breach of Rule 638(1)(d) in that J Fawcett (OCEAN CHIEF) angled her mount outwards near the 300 metres when not clear of SOPRANO SUPREME (S Collett) which was checked.

Ms Selvakumaran used two video angles to demonstrate the incident. At the 300m Ms Fawcett was in a position towards the back of the field. Seeking a run, she angled out into the line of Ms Collett, when not sufficiently clear of that runner, preventing Ms Collett from riding her mount out for 6- 7 strides.

Ms Fawcett said the films spoke for themselves. She was desperate for a run and misjudged how clear she was of Ms Collett.

Submissions for Penalty:

Mr Goodwin said Ms Fawcett did not have a good record. Careless riding charges in the previous 12-month period are as follows:

31/3/21 – Matamata - 5 days
1/1/21 – Auckland - 4 days
26/9/20 – Auckland - 4 weeks
29/8/20 – Tauranga - 7 days
25/7/20 – Counties - 3 days
15/7/20 – Counties - 2 days

Mr Goodwin said Ms Fawcett had shown little patience and should have waited for a run. He said, because of the incident, Ms Collett had to take a hold of her mount. He described the breach as low end and the Stewards’ submission was for a term of suspension.

Ms Fawcett explained it was difficult for a Rider to get back on a horse after a period away when other riders had taken their place. For this reason, she asked the Committee for a lesser number of days suspension and an increased fine.

Ms Fawcett advised of riding commitments at Rotorua next Saturday.

Reasons for Penalty:

The Committee’s assessment of Ms Fawcett’s carelessness was higher than that of the Stewards. Riding the favourite, and acting in desperation, she angled out sharply over several horse widths. In doing so she crossed in front of SOPRANO SUPREME when only her own length clear causing interference to that runner. Ms Collett was checked and had to change ground and rebalance her mount. The films, when viewed through to the finish, showed SOPRANO SUPREME finishing strongly after recovering from the check. Ms Fawcett made no attempt to correct her line of running and her actions suggested little regard for fellow riders.

We placed her carelessness in the midrange and adopted a starting point of 5 days and $500.

A significant aggravating factor was Ms Fawcett’s poor riding record with this being her 7th careless riding charge in 12 months (463 rides). An uplift of 2 days was applied.

We did not believe it appropriate to substitute any of the suspended days with an increase in monetary penalty and no credit was applied for Ms Fawcett’s admission of the breach. The incident was clear-cut, there were no contributing factors from any other rider and the charge would have been difficult to defend.

Taking in to account all submissions it was our opinion a 7-day suspension and a $500 fine was an appropriate penalty.
