Facts:
Following Race 3 (John and Natalie Mabey 2600) Mr Balcombe lodged an information with the Judicial Committee alleging a breach of Rule 638 (3) (b) (ii) in that K Veenendaal used her whip excessively prior to the 100m.
Rule 638(3) (b) provides
A Rider shall not:
(ii) strike a horse with a whip in a manner or to an extent which is excessive
The “Guidelines with Respect to Acceptable Use of the Whip” provide:
Without affecting the generality of Rule 638(3) (b) a rider may be penalised if their whip use is outside of the following guidelines:
Inside the final 600 metres of any Race, official trial or jump-out a horse may be struck with the drawn whip up to five times after which the rider must cease their use of the whip for a minimum of five strides before striking the horse again with the drawn whip, with this restriction to apply prior to the final 100 metres. The whip may then be used at the rider’s discretion until the winning post is reached. Prior to the final 600 metres of a race, official trial or jump-out the use of the drawn whip is acceptable if used in moderation and not continually.
At the outset of the hearing, Ms Veenendaal confirmed that she understood the charge and that she admitted the breach.
Mr Balcombe played the videos from the home turn to past the 100m mark.
Ms Veenendaal (ZENTANGLE) was near the lead and racing closest to the fence. After rounding the turn, she commenced to use the whip and, from that point through until the 100m, struck her mount approximately 13-14 times. There were 2 breaks of 2- 3 strides within that period.
Ms Veenendaal agreed with the Stewards’ assessment of the number of strikes. She said it had been some time since her last stint of riding and she was still adapting to the whip guidelines.
Submissions for Penalty:
Mr Balcombe said Ms Veenendaal had a clear record under this rule, not only for the previous 12 month period but over her riding career to date. He submitted a fine was an appropriate penalty.
Ms Veenendaal said she just got a little carried away today but would be concentrating on getting it right for future rides.

The Penalty Guide for Judicial Committees provides the following starting points for breaches of Rule 638(3) (b) (ii):
1st breach $300
2nd breach $500
3rd or subsequent breach 6-8 national riding days
In determining penalty, the Committee adopted a starting point of $300.
Ms Veenendaal’s total number of strikes before the 100m was well outside of the guidelines; however, we note that her whip use was not continuous and the strikes were not forceful. She did give some respite (approximately 3 strides instead of 5) and expressed commitment to riding within the rules in the future.
We have taken into account Ms Veenendaal’s clear record and the fact that because she holds a Class D license, it has been some time since she last rode regularly. Balancing up all factors it was our opinion that a $300 fine was appropriate.
