Decision: --
After the running of Race 2 at Woodville the Bill and Olive Smith Maiden, Mr B Herd, jockey of Kalamari, provisionally placed 4th by the judge, protested against Star Conquer provisionally placed 2nd
--
Prior to the commencement of the hearing all connections except Mr G Vile (Trainer) were present. Mr Vile arrived soon after the commencement.
--After the running of Race 2 at Woodville the Bill and Olive Smith Maiden, Mr B Herd, jockey of Kalamari, provisionally placed 4th by the judge, protested against Star Conquer provisionally placed 2nd, alleging interference in the home straight. The margins were Long Neck, 1 ? length, short head.
--Mr B Herd used the available films, head and side on, to illustrate his belief that his horse was effected by the inside movement of 2nd place, Star Conquer. He indicated that he was left with little option but to change ground and move from a position that he was entitled to be to get a run. He believed he lost ground.
--Both Jockey Calder and trainer G. Vile had no questions initially. However, G. Vile (Trainer) questioned whether or not there was movement inwards from the provisional winner Pole. Jockey B. Herd conceded that that horse did roll inwards.
--Jockey A. Calder viewed both films and informed the committee that there was movement from the outside horse, Pole. He believed Mr Herds mount had run its race and although the gap closed he was unable to take advantage earlier.
--Trainer K. Gray informed the committee that his horse did have to change ground and that his horse did take a straight line.
--Stipendiary Steward H. Goodwin, when asked to comment, indicated he believed that although Kalamari did change ground and his line was taken, there were contributing factors which caused the changing of ground to happen.
--Decision and Reason:
--The committee viewed the available films (head and side). The films clearly showed, especially the head on, that there was movement from a number of horses at the point of the alleged incident. Pole, the provisional winner, did move inwards at about the same time that Jockey B. Herd elected to change ground. Prior to that point of the race, Star Conquer racing nearest to the rail, did move inwards, but at no stage did the jockey of Kalamari stop riding or contact made. The committee was of the opinion that the decision by Jockey B. Herd to change ground was contributed to by the inward movement of the initial winner Pole. Because of a number of contributing factors the committee were of the opinion that placings stand and the protest was dismissed.
