Code:

Hearing Type (Code):

Meet Title:
Woodville - Pahiatua RC - 5 October 2006
Race Date:
2006/10/05
Race Number:
Race 10
Decision: --
Following the running of Race 10 at Woodville, Miss. K. Hercock was charge under rule 871 (1) (d) in that passing the 500 metre mark Miss K Hercock (Our Manciano) permitted her mount to shift out when not sufficiently clear of Charleston (L. Cropp), resulting in that runner being taken out across the running of Our Phoebee (B. Herd), which was checked.
--
Rule: 871 (1) (d)
--Miss Hercock did not admit the breach.
--Following the running of Race 10 at Woodville, Miss K Hercock was charge under rule 871 (1) (d) in that passing the 500 metre mark Miss K Hercock (Our Manciano) permitted her mount to shift out when not sufficiently clear of Charleston (L. Cropp), resulting in that runner being taken out across the running of Our Phoebee (B. Herd), which was checked.
--Mr. N. Goodwin, Stipendiary Steward, showed the available film and indicated he believed she angles her mount out when not sufficiently clear causing a check to both Charleston (L. Cropp) and to Our Phoebee (B. Herd).
--Mr. C. George, Stipendiary Steward, informed the committee that at the point of the incident both horses, Charleston and Our Phoebee, were to be where they were and racing clear from Miss Hercocks mount. He believed Miss Hercock was never sufficiently clear or in a position to shift outwards. He believed Miss Hercocks actions caused Miss L Cropp to take hold of her mount, which in turn resulted in Jockey B Herd having to check his mount.
--Miss K Hercock informed the committee that her horse was always travelling well, she felt her body weight and movement contributed to her mount moving outwards on the point of the bend. She informed the committee that she believed her horse clipped the heels of the horse racing in front of her a couple of times and she had to ease at least twice.
--Miss Hercock was asked to use the available film to point out the point of the race to which she believed she had to ease off. Miss Hercock was a little unsure where the easing off did occur.
--Mr. Goodwin in summing up, believed that even if Miss Hercock's mount did clip heels, she was obliged to take hold but instead elected to move outwards which resulted in tightening to two other horses. Miss Hercock had no other comment.
--Decision and reason:
--The film clearly showed that Our Marciano (Miss Hercock) did move out when not sufficiently clear. Both Miss Cropps mount and Mr Herds mount were entitled to be where they were and Miss Hercocks actions caused Miss Cropp to take hold, which caused Mr Herds mount to be checked. The committee found the charge proven.
--Penalty:
--Submissions were called for penalty. Mr Goodwin (Stipendiary Steward) informed the committee that her record over the past 12 months was very good, she had not been charged under this rule for that period of time. He did however inform the committee that he believed the interference caused by Miss Hercocks actions necessitated a period of suspension.
--Decision:
--The committee in considering the penalty took into account Miss Hercocks good riding record (not having been charge under this rule for 12 months). They also noted that Miss Hercock did not admit the breach of the rule. The committee is of the opinion that this was not a minor breach of the careless riding rule, two other horses were effected. The committee concurred with Stipendiary Steward Goodwin that this charge should result in a suspension and accordingly Miss Hercock was suspended from race riding after the completion of racing on Saturday 7th of October until the completion of racing of Saturday the 14th of October.
