Following the running of race four LK Cropp, the rider of HEPBURN instigated a protest against MURKIT, ridden by J Symes for alleged interference in the home straight

--Following the running of race four LK Cropp, the rider of HEPBURN instigated a protest
--against MURKIT, ridden by J Symes for alleged interference in the home straight. The provisional placings were 1st MURKIT, 2nd HEPBURN. The margin between 1st and 2nd was a nose.
--Miss Cropp informed the committee that approximately 175 metres from the finish the provisional winner MURKIT moved out onto her horse and contact between the two was made. She believed her line was taken and the outward movement by MURKIT on to her mount caused her to roll out. She believed the movement outward was substantial.
--Both films, head and side on, were shown and Miss Cropp reiterated her belief that the bump and the outward movement of MURKIT on to her mount contributed to her running second. Her mount did reach the front but got run down.
--Trainer H Matthews ( HEPBURN) told the committee that he had nothing to add. He had viewed the race from the stand and it was only after talking to Miss Cropp and viewing the head on film that he believed his horse's chance of finishing in a higher place was affected. He stated that there was definitely outward movement.
--Jockey J Symes informed the committee that he believed Miss Cropp's horse rolled inwards on to his just before contact was made. He was adamant that Miss Cropp did not stop riding and never called. He also viewed both films.
--Trainer Mr S Lennox concurred with Jockey Symes that the initial movement was inwards from Miss Cropp's mount. Then it became a battle between the horses to the finish. He believed the movement and contact had not cost Miss Cropp's mount any ground.
--Mr L N McCutcheon (Chief stipendiary steward) was asked to comment. He told the committee that doubt did exist as the initial movement inwards was made by HEPBURN (Miss Cropp's mount). In the run to the line there was movement outwards by both horses.
--DECISION
--Rule 876 (1) requires us to ask whether interference occurred and then if so whether that interference has cost the horse interfered with from finishing in a better placing. In our view the head on film confirmed the initial movement inward was from Miss Cropp's mount HEPBURN and contact was made, albeit briefly on MURKIT. Both horses did then continue on an outward line but the film concurred that no further contact was made in the run to the line.
--We were mindful of the margin (a nose) but were of the opinion that at no stage did Miss Cropp stop riding her horse and did not lose any ground. We were also mindful of the fact that Miss Cropp's mount reached the lead and was run down just short of the winning post.
--Accordingly the placings were allowed to stand.
--The committee issued its decision within a tight timeframe and was aware of the fact that Miss Cropp was not present at the announcement of the decision as she had riding commitments in the next race.
