Facts:
Apprentice Jockey KN Teeluck represented by Mr K Gray (Trainer) admitted a breach of rule 638(3)(b) in Race 1 "The Tui backing a winner since 1889" Handicap.
The information reads - Apprentice KN Teeluck used his whip unnecessarily on STAR EMERALD over the final stages when not in contention.
Mr Teeluck confirmed the breach was admitted and that he understood the rule.
Stipendiary Steward, Mr L Tidmarsh using the available films showed the incident and submitted that STAR EMERALD was not in contention through the final stages of the race but jockey KN Teeluck continued to strike the horse unnecessarily.
Mr Teeluck confirmed the submissions of Mr Tidmarsh and his representative, (Mr Gray) also confirmed the incident.
Mr Tidmarsh informed the committee, that the line between unnecessary use of the whip and not riding a mount out is quite small and apprentices must learn to adjust.

Mr Tidmarsh confirmed that this was Mr Teeluck first breach of the rule, he viewed the incident at the lower end of the scale and asked for a monetary penalty of between $200 and $300.
Mr Gray asked for Mr Teeluck’s record to be taken into account and that any monetary penalty imposed be at the lowest end of the scale.

In coming to the decision to impose a monetary penalty the committee considered all the submissions. A perusal of the penalty guide indicates a starting point of a monetary penalty of $300, for the first offence.
The committee used its discretion to reduce the amount because of Mr Teeluck's admittance of the breach of the rule and that it was his first charge under this rule. It was pointed out to Mr Teeluck that incidents like this do not look good on Trackside television and that he has responsibilities to ensure he rides within the rules.
