Prior to the running of race 6 at the Woodville/Pahiatua race day The King Cattle Equipment 1400 apprentice jockey R Cuneen was charged with a breach of Rule 330 (3) (6 ) in that he broke a riding engagement in race 6 on CILLA CROSS for trainer K Lawrence.
Rule 330 (3) (a ) reads: A rider shall not wilfully or without reasonable cause break a riding engagement.
Submissions for Decision:
Ms Lawrence informed the committee that she had rung a number of riders looking for a rider for CILLA CROSS. Mr Cuneen initially said that he had a ride in the race but that evening he contacted Ms Lawrence saying he did not have a ride and was available. She believed that Mr Cuneen was engaged for the ride and she was surprised to see on the racing website that he was not down to ride her horse and had been engaged to ride for Mr G Vile.
Ms Lawrence then tried to contact Mr Cuneen during the day and finally contacted him about 9o'clock that same evening. He informed her that there had been a mix up and he was to ride Mr Vile's horse.
Mr Cuneen informed the committee that he did receive a call from Ms Lawrence asking him to ride CILLA CROSS. He believed that it was in the 1600 metre race and that 1600 metre maiden race had attracted a large number of nominations and may have to be split. On declaration day he noticed he was down to ride Mr Vile's horse as agreed. He understood that his ride for Mr Vile was in the maiden 1400 metre race. He tried to contact Ms Lawrence to inform her that he was down to ride Mr Vile's horse and finally left a message. He rang the racing bureau to inform them he was riding for Mr Vile. Ms Lawrence confirmed that she did receive a voice mail from Mr Cuneen but was surprised that the racing bureau could change riders without contacting her.....the trainer of CILLA CROSS.
Mr Brown submitted that there had been a mix up. The fact that there was a 1400 metre race and a large number of nominations for the 1600 metre race in which Ms Lawrence had indicated a preference to run only complicated the situation. He believed that a genuine mistake had been made but like Ms Lawrence he was surprised that the racing bureau could confirm a jockey in a race without contacting the trainer of another horse in the same race who may have been under the impression that the jockey concerned was riding for her.
Mr G Vile confirmed that he did engage Mr Cuneen to ride for him in the race concerned.
Mr Cuneen told the committee he had been riding for two years and that it was his intention to travel up to the Central Districts to ride more often.
Reasons for Decision:
The committee in coming to its decision considered the submissions of all the parties to this charge.
Mr Cuneen confirmed that contact by phone and voice mail was made to trainer K Lawrence. He also, as confirmed by Mr G Vile, had contacted him to ride and believed that the riding engagement with him was his. There was confusion between Mr Cuneen and Ms Lawrence over which race CILLA CROSS was to race in. The large number of nominations indicating a split field also added to the misunderstanding.
Ms Lawrence clearly believed that Mr Cuneen was to ride for her and the difficulty and time delay in contacting Mr Cuneen certainly added to the confusion.
The committee was, like Ms Lawrence, surprised that after talking to the racing bureau she was not contacted by them confirming that Mr Cuneen was to ride for Mr Vile. There was, in the committee's opinion a number of conflicting issues in this charge. It only reinforced the committee's view that all parties in engaging riders must ensure that the proper procedure is followed.
