Following the running of race 3, the Woodville Horse Floats 1400, Mr Tanaka was charged with careless riding under rule 638 (1) (d). The information alleged that “you (M Tanaka) allowed your mount to shift outwards when not clear of MAREA ALTA (Kelly Myers) near the 300m”.

--Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”
--Mr Tanaka admitted the breach of the rule and was assisted by licensed trainer Mr G Barlow. He also agreed he understood the charge and the rule it was laid under. As the breach of the rule was admitted the charge was proven.
--Stipendiary Steward Mr Goodwin showed the head on and side on video film from the top of the straight. He said Mr Tanaka was towards the outside of the field and at approximately the 300m mark he rolled out on FIRE CHIEF and caused tightening to Ms Myers. He then hit his horse with his whip instead of taking the time to straighten up his mount. Mr Goodwin believed Mr Tanaka could and should have made more effort to straighten his horse and by not immediately doing so was guilty of careless riding.
--Mr Tanaka said that his moving out was caused by him being bumped from his inside and simultaneously changing his hold of his horse so that he could commence to use his whip. He agreed he did hit his horse after it had moved out. Mr Barlow said that FIRE CHIEF had overreacted to the movement from his inside but agreed Mr Tanaka should have shown more care and immediately straightened his horse.

--Mr Goodwin said Mr Tanaka had only been charged once previously under this rule in the previous 12 months – on 8 August 2009 when he was suspended for 4 days. He said Mr Tanaka was a good rider and a leading apprentice in the central districts and was rarely required to come before the stewards. He described the offending at the lower end of the scale and said that the stewards believed an appropriate penalty would be a suspension of 4 days. Mr Tanaka said that he had confirmed rides for Thursday 29 and Saturday 31 October and would like any suspension to begin after the close of racing on 31 October.
--Decision
--In coming to a decision on penalty the Committee considered all the submissions made as well as Mr Tanaka’s previous good record and his admittance of the breach. We also agree with the stipendiary steward that the offence is at the low end of careless riding. However, you did move out into the rightful line of Ms Myers and, having moved out, you did strike your horse once before straightening up. We have also taken into account that you wish to ride on both 29 and 31 October 2009. You are suspended from the close of racing on Saturday 31 October 2009 until the close of racing on Saturday 7 November 2009 that being 4 North Island days.
