Facts:

Apprentice jockey M Singh admitted a breach of rule 638 (1) ( D ) in that he allowed his mount BELLA’S DELIGHT to shift out on the home turn checking RED MAFIA, the mount of E Farr then continuing to move out dictating her line to the post.

Rule 638 (1) (d) reads: A rider shall not ride a horse in a manner the judicial committee considers to be careless.

The race concerned (THE ALL DIAMONDS ZEDACE SYNDICATE 2100) was the subject to an earlier protest. Mr Singh informed the committee that he understood the charge.

Mr Goodwin, using the available film of the incident for Mr Auret's benefit took the committee through the breach. The films clearly showed Mr Singh's mount moving onto and dictating Miss Farr's line not only after straightening but also in the run to the line.

Mr Auret agreed with Mr Goodwin's interpretation of the incident and stated that it was not a particularly good piece of horsemanship.

Mr Goodwin did comment that Mr Singh deserved some credit for attempting to straighten his mount albeit for a few strides but he believed Miss Farr was severely inconvenienced by his actions. He felt that Mr Singh threw caution to the wind in his endeavour to win the race.

Both Mr Singh and Mr Auret had no further comment.

Submissions for Penalty:

Mr Goodwin stated that he felt it was a breach of the rule at the higher end of the scale. Mr Singh's actions had caused a relegation and the punters and owners had been affected. He felt some credit should be given to Mr Singh for his attempt to straighten. He asked for a period of suspension of 8 days to be imposed.

Mr Auret agreed with Mr Goodwin's comments.

Reasons for Penalty:

The committee viewed the incident at the higher end of the scale. The interference to Miss Farr's mount was severe, contact was made and her rightful line of running was dictated to. Some credit should be given for Mr Singh's admittance of the breach and his attempt after the first inward movement to straighten. We note that Mr Singh had been charged on 18 May 2016 at Wanganui for a breach of the careless riding rule. He is a Central Districts rider only and apprentice to Mr Auret. It was the committee's belief that no reduction on the 5 day suspension guidelines could be afforded in this case. Incidents like this must be treated in a way that reflects the seriousness of the breach and after discussion the committee agreed on a period of 8 days as the starting point. We did in coming to our final decision allow for one day's discount for his admittance of the breach, his riding record and his brief attempt to straighten. Mr Singh had indicated to the committee he had firm race day commitments on Saturday 29 October at Manawatu and any period of suspension to be imposed to take place after that. As the day concerned falls within the deferred time period it was so agreed.
