As Mr Fannin admitted the breach the charge was found to be proved.

Taking into account all of the submissions we fined Mr Fannin the sum of $200.00.
Facts:
Mr Tidmarsh lodged an information with the Judicial Committee alleging a breach of Rule 638 (3) (b) in that S Fannin used his whip excessively prior to the 200 metres. Mr Thurlow was present to assist Mr Fannin throughout the hearing.
The films were shown from both side-on and head-on perspectives. Mr Fannin was racing in the trail and could clearly be seen to hit his horse ten times without any respite, from the bend up until the 200 metre mark.
Submissions for Penalty:
Mr Tidmarsh told the committee that Mr Fannin’s record showed only one previous breach of this rule in September last year. On that occasion, while riding as an amateur, he was fined $100. Mr Tidmarsh said today’s breach was not at the top end and Mr Fannin was still learning his trade. The Stewards’ submission was for a monetary penalty in the vicinity of $200.
Mr Fannin said he was told his mount was a “lazy” horse and needed to be ridden hard. Today it had been reluctant to go into a gap that presented in front of him. Another rider had also been charged with excessive use of the whip on the same horse five starts prior when it won the race. Mr Fannin said he believed he was in with a chance which is why he hit the horse as much as he did.
Reasons for Penalty:
The committee had regard to the recommendations outlined by the Judicial Committee penalty guide which suggests a $300 starting point for excessive use of the whip. We gave credit for Mr Fannin’s early admission of the breach and his good record. We also considered the number of strikes over the guidelines, which in our opinion placed the breach towards the lower end. Mr Fannin was reminded that following trainers’ instructions did not permit him to ride outside of the rules of racing.
