The protest was dismissed and placings as called by the judge were allowed to stand.

Facts:

Following the running of the 2nd race at the Woodville Pahiatua meeting (The Rural Direct Dannevirke 1200) a protest was lodged by J Brenner the trainer of the provisionally placed 2nd horse LUCY LIU against the provisionally placed winner PERFECT HARMONEE.

Rule 642(1) reads:
If a placed horse or its rider causes interference within the meaning of this rule 642(1) to another horse and the judicial committee is of the opinion that the horse interfered with would have finished ahead of the first mentioned horse had such interference not occurred they may place the first mentioned horse immediately after the horse interfered with.

The information read PERFECT HARMONEE shifted ground in the home straight and affected the chances of LINDY LIU.

Submissions for Decision:

Mr J Brenner using the available films (especially the head on) informed the committee that just before the 400 metre mark LUCY LIU racing in the trail shifted off the rail to make her run. He believed his horse was hampered in going for a gap because of the outward movement of PERFECT HARMONEE, The movement he indicated was substantial and caused his horse to lose ground. He believed the incident happened about the 400 metre mark and the continual outward movement of PERFECT HARMONEE for at least 100-150 metres affected his horse. He felt that LUCY LIU closed to within 1/2 length at the finish. (The official margin between 1st and 2nd was 1/2 length).

Jockey Mr N Teeluck told the committee his mount received a bump and that with the outward movement of PERFECT HARMONEE meant he was unable to ride his mount out at a crucial time in the race.

Mr Myers informed the committee that there was outward movement from PERFECT HARMONEE but the gap that was presented should have been taken by LUCY LIU. He felt that the horse was not good enough to take advantage of the gap and was not taking ground of the provisional winner over the last 100 metres.

Jockey Mrs L Allpress confirmed to the committee that she believed LUCY LIU was not travelling well enough to take advantage of the gap. There was movement from the horse on its outside which may have also contributed to the incident.

Stipendiary steward Mr N Goodwin was asked to comment on the incident. He informed the committee that approaching the home turn the mount of Mrs Allpress was hanging and commenced to move outwards. There was a gap presented to Mr Teeluck's mount and that PERFECT HARMONEE did move out, He confirmed that the incident occurred at about the 400 metre mark and there was movement from other horses at the point of the incident and in the run for the line.

Reasons for Decision:

In coming to its decision the committee carefully considered the evidence presented.  There was little doubt that there was outward movement from PERFECT HARMONEE at the point of the bend and on straightening. Mr Teeluck was entitled to be where he was and poised to take advantage of the gap that became available. Contact all be it slightly did occurr and there was a slight inward movement from Miss K Myers mount WILD CARD. The committee was mindful that the incident happened at the top of the straight and although the outward movement of PERFECT HARMONEE continued for about 100 metres the gap that was presented was still available in the run down the straight. There was considerable doubt in the committee's mind whether LUCY LIU was travelling well enough to take advantage of the gap that was presented. The committee was also mindful that LUCY LIU was not taking ground off PERFECT HARMONEE in the final stages.
