Facts:
Following the running of race 4 at Woodville (The Hoffman and K B Ford 2100) Jockey, S Fannin admitted a breach of Rule 638 (3)(b)(ii) in that he used his whip excessively prior to the 200 metres mark without the necessary respite on his mount TENSILE.
The relevant rule reads
( rider shall not strike a horse with a whip in a manner or to an extent which is excessive.
Mr Fannin after having the rule read to him confirmed he admitted the breach and it was therefore deemed proved.
The available films of the incident were shown and Stipendiary Steward, D Balcombe pointed out that after rounding the home turn TENSILE was struck twelve times up to the 200 metre mark, well outside the guidelines. No respite was shown by Jockey Fannin.
Mr Fannin concurred that the incident was outside the guidelines and the rules and that it was an error of judgement on his behalf. In reply to a question from the committee he agreed a number of the strikes were quite forceful.

Mr Goodwin informed the Committee that this was Mr Fannin's first breach of this rule. He is one of New Zealand's outstanding jumps and highweight jockeys whose record is most impressive in the 200 odd race rides that he has had. He believed the breach could be best handled by way of a fine and he was aware of the starting point for breaches under this rule in the JCA Guidelines. Because of Mr Fannin's record he believed a monetary penalty below the recommended starting point be imposed.
Mr Fannin had little to add except to reiterate his annoyance at himself for having breeched the rule and his determination not to see it repeated.
