Mr Goodwin showed the film and said that shortly after the start Mr Collins (INVEST TO RULE) allowed his mount to shift inward when not clear of TRIDANE ridden by Johnathon Parkes, which clipped a heel, stumbled and unbalanced the rider.

Mr Collins stated that he had nothing to say on Mr Goodwin’s interpretation of the film.

Mr Goodwin advised that Mr Collins had an excellent riding record and had not been charged under this rule for well over 12 months. He recommended a suspension of four riding days.

Mr Collins confirmed that he only rides in the Central Districts and when asked about his upcoming engagements said he had a confirmed ride at Hastings on 4 October and expected to ride at Taupo on 08 October.

After reviewing the films and considering the submissions made the Committee took into account Mr Collins’ admittance of the breach and his very good riding record but also that the breach was a serious one that nearly caused another rider to fall. Mr Collins is suspended from racing from the conclusion of racing on Saturday 04 October 2008 to the conclusion of racing on Thursday 16 October 2008 that being 4 riding days.
