I was not of the opinion that the horse interfered with would have finished ahead of the first mentioned horse had such interference not occurred, and the protest was dismissed.
Placings as provisionally called by the judge were allowed to stand and payment of dividends authorised.
Facts:
A protest was lodged by Miss. R. Myers alleging Princess Sienna shifted in on the home straight and caused a check to Bliss. Rule 642 (1) reads ‘If a placed horse or its rider causes interference within the meaning of this rule (642) to another placed horse and the Judicial Committee is of the opinion that the horse interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with’.
Margins between 3rd and 5th were short head and short neck.

Submissions for Decision:
Miss. R. Myers, rider of Bliss provisionally placed 5th by the judge, used the available films (head, side and back) to point out the alleged incident in which Princess Sienna, provisionally placed 3rd by the judge, moved inwards onto her line of running. She told the committee that she mounted a run down on the inside and believed the gap created was hers to take. The gap was then closed by Mr. Hannam's mount’s inward movement forcing her to take hold and change ground. When she became balanced her mount was making up ground on the place getters at the line.
Miss. Myers agreed to a question from Mr. Hannam that the gap was marginal and that she was not in the gap when she changed ground. She also agreed with a statement from Mr. Hannam that Mr. Parkes' mount, Gold Lane, did slightly take her line.
Mr. Lowry told the committee that it was his belief that Mr. Hannam's action in moving inward cost his horse third placing.
Mr. Hannam had little to add in his submission. He did agree that he did move inwards to take a line he was entitled to. That line was slightly dictated to by Mr. Parkes' mount's movement. He believed that his mount was going the best when the gap was presented and that he was marginally clear, and at no time was Miss. Myers in the gap when he moved inwards.
Miss. Myers had no questions.
Mr. Goodwin, Stipendiary Steward, informed the committee that Mr. Hannam took the actions that he did of his own volition. Miss. Myers did angle her mount for the gap. He did concede that Miss. Myers was not in the gap but did point out that Mr. Hannam was only marginally clear. It was his belief that Mr. Parkes' actions did not dictate Mr. Hannam's decision to shift ground. He had no comment on the merits of the protest.
Reasons for Decision:
All available films were revisited. The head on film clearly showed a gap down on the inside being presented in the run to the line. Mr. Hannam was entitled to take that gap and the movement from Mr. Parkes’ mount (the eventual winner) did, I believe contribute, albeit slightly, to the incident. Mr. Hannam did come across in search of the run and Miss. Myers also believed it was her best opportunity to mount her run. Miss. Myers was not in the gap when Mr. Hannam moved inwards and she then, to continue her run, changed ground and came out and around.
While acknowledging that the margins between third and fifth were a short head and a short neck, it was clear on the side on film that Mr. Hannam did ease his mount down in the final few strides.
