Accordingly, Mr Parkes’ license is suspended from the close of racing on Thursday 25th April up to and including racing on Thursday, May 2nd 2019.
Facts:
Following the running of Race 3 (Naylor Lawrence & Associates/Tararua Heliwork 1200), an Information was lodged by Mr D Balcombe alleging a breach of Rule 638(1) (d) in that J Parkes permitted his mount “RED PEPPER” to shift outwards making solid contact with “AMPUIS” near the 350 metres.
Using three available video angles, Mr Oatham explained the incident that lead to Mr Parkes facing a careless riding charge.
RED PEPPER was trailing the field at the 400m mark when Mr Parkes angled outwards to make his run. On the bend, when riding outwards, he made firm contact with the mount of Charlotte O’Bierne (AMPUIS). Mr Parkes forced a run when there was none available making forceful contact with AMPUIS.
Mr Parkes said while the incident happened it was his opinion that there was only a little bit of contact between his horse and AMPUIS.
Submissions for Penalty:
Mr Balcombe was invited to make submissions on penalty. He described Mr Parkes’ record as exceptional with no careless riding charges in the last 12 months over 607 rides. Mr Oatham checked the database to find that the last time Mr Parkes faced the judiciary on a careless riding charge was in July 2017 (over 1000 rides ago).
Mr Balcombe described today’s breach as midrange and submitted that a suspension was an appropriate penalty.
Mr Parkes asked the Committee to take note of his excellent record and suggested the incident had been over-dramatised. He maintained that the bump between his horse and Ms O’Bierne was minor.
In the event of suspension, Mr Parkes advised of riding commitments through until racing next Thursday at Awapuni.
Reasons for Penalty:
The Committee placed the degree of carelessness at just below midrange. Mr Parkes swung wide on the bend to gain a clear run and in doing so made contact with AMPUIS who was racing wider on the track. We reject Mr Parkes’ assertion that the incident was minor. The video clearly showed the hindquarters of AMPUIS being swung outwards indicating that the contact had been reasonable forceful. A suspension is an appropriate penalty, and we adopted a starting point of 7 days.
Mr Parkes is a very busy rider, and it has been almost 2 years since his last careless riding charge. This is an exceptional record which we have given Mr Parkes credit for. Balancing up all factors, including Mr Parkes’ admission of the breach, it was the Committee’s opinion that a five-day suspension was an appropriate penalty.
