Facts:

Following Race 9, the Pahiatua Golf Club Sprint , a protest was lodged pursuant to Rule 642(1) by Ms R Smyth alleging that horse number 12 (CAULFIELD) or its rider placed 2nd by the Judge interfered with the chances of horse number 13 (DIXIE EXPRESS) placed 3rd by the Judge.

The information alleged interference in the home straight.

The official margin between first and second was a nose.

Submissions for Decision:

Ms Smyth told the committee that as she rounded the home bend Mr Dell riding CAULFIELD came up on her inside and bumped her mount when angling out for a clear run. She said this put her horse off balance and for the next 800m he continued to dictate her outwards. Three different views of the final stages of the race were shown. Ms Smyth told the committee the actions of CAULFIELD prevented her finishing in a higher placing. Mr Rennie said that due to the outward movement of CAULFIELD Ms Smyth ended up far wider on the track.

Mr Dell explained how he was 1 ½ lengths behind DIXIE EXPRESS as they rounded the bend for home. He quickly made up ground on Ms Smyth’s mount and admitted that as he came up alongside there was a slight bump. He said from that point on the other horse, DIXIE EXPRESS, raced very greenly and at the 200m there was a clear horse width between the two horses. He said Ms Smyth at no stage had to stop riding.

For the Stewards Mr Goodwin said the only interference that occurred was the bump at the top of the straight. From that point on both horses shifted out under pressure. He said it was significant that Mr Dell came from a position behind Ms Smyth.

Reasons for Decision:

In coming to a decision the committee carefully considered all of the evidence presented. DIXIE EXPRESS received a single bump from CAULFIELD as Mr Dell angle out for a clear run on the bend. Following this contact the head-on film showed both horses drifting outwards for some time but we did not believe that DIXIE EXPRESS was dictated outwards by CAULFIELD. DIXIE EXPRESS was racing very greenly and appeared to be running away from CAULFIELD. In order to uphold the protest we had to be satisfied that, free of interference, DIXIE EXPRESS would have finished ahead of CAULFIELD.

In dismissing the protest the Committee was of the opinion that minor interference occurred at the top of the straight but the outward movement that followed was due to the racing manners of both horses but in particular DIXIE EXPRESS.
