Facts:

After the running of Race 3 at Woodville the Affco/MacDougalls metric mile a protest was lodged by the Stipendiary Stewards alleging interference on the home straight. The Provisional placings as called by the judge were.

1st - Phoenix Tycoon (7)
2nd - Doing Time (10)
3rd - Jed Clampett

The protest concerned the 2nd and 3rd.

Rule 642 (1) reads: “If the placed horses or its rider caused interference within the meaning of this rule 642 to another placed horse and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.”

Present at the enquiry were Mr R Connors trainer of Doing Time, A Kuru Jockey, S Lennox trainer of Jed Clampett, N Quinn Jockey.

Submissions for Decision:

Mr R Neal (Co-Chief Stipendiary Steward), using all available films indicated the incident in the run down the home straight.

He pointed out that Doing time (A Kuru) racing down on the inside moved outwards and made contact with Jed Clampett (N Quinn).

He informed the committee that initially the movement was gradual but contact was made on at least 1 occasion in the final stages.

Mr Neal told the committee that it was his belief that Jed Clampett was travelling well into the race over the final stages and was taking ground off Doing Time. He believed that Jed Clampett‘s chances of finishing in a higher place was extinguished by Doing Time’s actions, and reinforced to the committee the margins between 2nd and 3rd was a nose.

A request by the committee to show again the head on films in slow motion, only in Mr Neal’s Opinion, reinforced the inconvenience that Jed Clampett suffered.

Mr R Connors (Trainer) had no questions of Mr Neal. He did however submit that he believed Jed Clampett was not too inconvenienced in the incident, he did not change stride or become unbalanced.

Jockey A Kuru told the committee it was his opinion that Jed Clampett‘s jockey (N Quinn) did not stop riding and the incident happened just short of the post.

Mr S Lennox (trainer) indicated the films showed it all.

Mr N Quinn (Jockey) confirmed contact was made on a number of occasions and his mount became unbalanced.

He believed the incident happened 50-100m from the finish not just short of the winning post.

Mr Goodwin (Stipendiary Steward) told the committee that it was the Stewards' belief that Jed Clampett did become unbalanced for at least 2-3 strides during the incident. He was adamant that Jed Clampett was taking ground off Doing Time, and reiterated contact was made on at least three occasions.

Reasons for Decision:

The committee was clearly of the opinion that Doing Time moved outwards and made contact on at least 3 occasions to Jed Clampett in the run to the line.

The head on film showed Jed Clampett was taking ground off Doing Time and was clearly hampered in the incident. The committee was of the view that if interference had not occurred at that vital time in the run to the line Jed Clampett would have beaten Doing Time.
