Penalty:

Mr. Nolan this committee imposes a period of suspension from race riding from the completion of racing today until the completion of racing on Wednesday the 21st of March (3 North Island days).

Facts:

Mr. D. Nolan admitted a breach of rule 638 (1) (d) in that passing the 1400 metres Mr. D. Nolan, the rider of Hempsted, permitted his mount to shift out when not clear of Lucks Penny which was dictated wider on the track. As the breach was admitted it was deemed proved.

Mr. Goodwin using the available films informed the committee that Mr. Nolan's mount was travelling evenly at the back of the field. The pace eased somewhat and Mr. Nolan elected to follow the Lowry runner Zsa Zsa into the race. Down on his inside Mr. D. Walker's mount Master Plan moved fractionally at the same time as Mr. Nolan moved off his line. He made contact with Miss Johnston's mount Lucks Penny forcing that horse off its line an estimated 3 – 4 horse widths.

He believed Mr. Nolan may have been in some bother when the pace eased. However, Miss Johnston was entitled to be where she was and her mount was forced outwards by Mr. Nolan's action. Mr. D. Nolan informed the committee his mount was a big horse and its racing action caused him some concern. He was struggling with the ride and his mount lent outwards onto Miss. Johnston's horse as he went for a gap. He felt it was Miss. Johnston's intention to keep him in but did concede that his actions took Miss. Johnston's mount off its line to which it was entitled.

Mr. Goodwin then commented that he did not believe that it was a safety issue that caused Mr. Nolan to move outward. He did have an option of staying in behind which he believed he should have taken.

Submissions for Penalty:

Mr. Goodwin submitted that this was Mr. Nolan's first day back riding after a 6 day suspension imposed at Otaki on the 25/02/2012. He is an Irish jockey who so far has had 20 rides in New Zealand. His record in Ireland is very good, over 200 rides with one careless riding suspension.

Mr. Goodwin submitted that the breach was not in the high range. The chances of other horses finishing in a higher placing were not affected by his actions and he did feel that Mr. Nolan was still coming to terms of riding conditions in New Zealand. He is considered a North Island rider only and had not accepted riding engagements for Trentham on the 17th of March. He asked for a period of suspension of 4 – 5 days.

Mr. Nolan had the determent rule explained to him and he concurred that he did not have rides at Trentham on Saturday the 17th but did have rides at Waipukurau on Friday the 23rd. He asked for any suspension to begin after racing today (15th March).

Reasons for Penalty:

Mr. Nolan in coming to our decision to impose a period of suspension for this breach we have taken into consideration your admittance of the breach.

This committee is concerned that this is your first day back riding after a period of suspension, only to be charged again under the same rule. Mr. Goodwin in his submissions felt that you are not totally familiar with New Zealand’s racing conditions. It is, Mr. Nolan, your responsibility to ensure that you ride within the rules and conditions. We are of the opinion that this breach could be classed in the low range and have taken into account your comments which have been confirmed on film that your mount did race unevenly when the pace slackened and tended to roll outwards of its own volition when you angled for a gap. Miss. Johnston was fully entitled to be on the line she was. We are firmly of the opinion that it was not a safety issue that caused you to take the actions you did. You did have the option of staying in behind as you were clear of other horses around you. We acknowledge you are a North Island rider only.
