DECISION & REASON

After Race 3 an information was lodged under Rule 871 (1) (d). Stipendiary Steward Mr Davidson used video film, both head and side-on, to highlight the alleged breach. He pointed out where Mr Bates, riding TASMANIAN DEVIL, allowed his horse to ‘run in’ and check TRIST ME MOMMA, ridden by Mr Todd.

In evidence Mr Bates stated that he felt that Miss Mundy, riding BRENDEL, had taken his line and that he felt there was sufficient room to move inwards. He stated that he ‘didn’t realise’ that there was insufficient room to legally make this move. He felt that this was a contributing factor.

The Committee adjourned to consider all the evidence – view the film again, and make its decision.

The decision of the Committee was to uphold the charge.

1. It was felt that clearly there was insufficient room to move inwards. Consequently TRIST ME MOMMA, ridden by J Todd was checked.
----
2. By his own admission Mr Bates stated that he was unaware of the horse on the fence, ridden by Mr Todd, which was clearly affected.

3. The Committee did not accept Mr Bates’ assertion that Miss Mundy’s horse, BRENDEL, no. 1, significantly contributed to the incident.

PENALTY

(When considering penalty the Committee were aware that Mr Bates asked for a 7 day deferment.)

Mr Bates’ suspension commences from the conclusion of racing on 30 November 2007 and continues up to and including the conclusion of racing on Saturday 8 December 2007, (effectively 3 riding days).
----
The Committee reminded Mr Bates that this was the suggested minimum suspension, that this was his third similar offence and that any further similar charge under this rule would be treated more severely.
